Public Offer
← CompanyThis Public Offer (the "Offer") is a proposal by the administration of the website v2.deafesg.com (the "Administration") to any legally capable person (the "User") to enter into an agreement, on the terms set out below, on the use of the DEAFESG esports platform for deaf and hard of hearing players (the "Website", the "Platform").
The Offer is addressed to an indefinite circle of persons and is a public offer under Article 437 of the Civil Code of the Russian Federation. The Offer is accepted fully and unconditionally by registering on the Website or by using any of its features that require an account. If you do not agree with the terms of the Offer, please do not register and do not use the Website.
1. Definitions
— Account — the User's personal account on the Website.
— Tournament — a competition held on the Platform; its terms are given on the tournament page and in its rules.
— Organizer — the Administration or a person to whom the Administration has entrusted running a tournament.
— D — the Platform's internal virtual unit (the balance in the profile).
— Premium — a paid subscription with extra profile customization and access to selected tournaments.
— Shop — the section of the Website with digital profile customization items (avatar frames, banners, badges).
2. Subject of the Offer
2.1. The Administration gives the User access to the Platform's features: profile and rating, verification, teams, tournaments, the Hub, messages (private conversations, team and tournament chats, the DEAFESG channel), news, the shop and Premium, the Telegram bot and the mobile version of the site (the DEAFESG APP).
2.2. Public sections of the Website (tournaments, news, ratings) can be viewed without an account. The main features of the Platform are free; paid terms are described in sections 5 and 6 of the Offer and on the pages of the Website.
2.3. The Administration may add, change and switch off features of the Platform, and change their appearance and contents.
3. Registration, verification and account
3.1. Accurate data must be given when registering. The Website is not intended for persons under 13; minor Users use the Website with the consent of their parents or legal guardians.
3.2. To unlock teams, the "My games" section, tournament applications and entry to Hub rooms, the profile must be verified: confirm the email address and submit a verification application (details and a link to a sign-language video). The decision is made by a manager of the Administration; in case of refusal the reason is shown on the verification page. Some features also require an approved profile photo.
3.3. One person — one account. It is forbidden to create additional accounts, to give an account to other persons or to impersonate another person.
3.4. The User is responsible for keeping the password safe and for all actions made under their account. Suspected hacking must be reported to support.
3.5. By linking a game account (Steam, FACEIT, Epic Games, Riot Games and others), the User confirms that the account belongs to them and allows the Platform to receive the public statistics of that account to display them in the profile.
3.6. The User may delete the account at any time in the settings. When an account is deleted, the profile, statistics, D balance and shop items are removed without compensation.
4. Rules of conduct
4.1. The following is forbidden on the Platform:
— using cheats, helper programs, match-fixing and other ways of unfair play;
— insulting other people, demeaning them on any ground, including hearing loss, threatening or harassing them;
— sending spam, unwanted advertising and malicious links;
— publishing illegal materials, as well as other people's personal data without their consent;
— trying to gain access to other people's accounts and to the service parts of the Website, or interfering with the work of the Platform;
— abusing reports, reactions and applications (including knowingly false ones).
4.2. In case of a violation the Administration may delete the material, restrict sending messages (for a period or indefinitely), reject an application, disqualify a participant from a tournament, or block the account. Decisions are made by the Administration; the reasons for a restriction can be asked about in support.
5. Tournaments, applications and prizes
5.1. Participation in each tournament is governed by the tournament page and its rules. By submitting an application, the User agrees to the rules. On matters of running a particular tournament, its rules take priority over the Offer.
5.2. An application is submitted by the team captain (in solo tournaments — by the player). The Administration may accept or reject an application, including for failing to meet the tournament's conditions (verification, profile photo, linked game account, region, Premium, team roster).
5.3. Match results are entered by Organizers on the basis of game data or materials sent by participants (a replay file, a photo or a screenshot of the result). If violations or mistakes are found, the Organizer may review the result. Organizers' decisions about a tournament are final within the Platform.
5.4. If a tournament has an entry fee, the payment method is shown on the tournament page: debiting D from the balance when the application is submitted, or a transfer to the details on the tournament page with a receipt attached. When paying by details, the application is confirmed after a manager checks the receipt.
5.5. Before a tournament starts, the User may cancel the application or leave the tournament. A fee paid in D is returned to the balance of the person who paid. A fee transferred by details is returned manually by the Administration to the person who paid, after a request to support or a manager's notification. After the tournament has started, the player has been placed in a team, or the team has entered the bracket, the fee is not refunded, except in cases directly provided for by the tournament rules. If the Administration cancels a tournament, the fees paid are returned.
5.6. The amount and kind of prizes (money, D, other) are shown on the tournament page. Prizes in D are credited to the balance. Cash prizes are paid to winners after the results and the recipient's data are checked; the winner provides the payment details. The User pays taxes and other mandatory payments connected with receiving a prize on their own, where the law requires it. The Administration may refuse to pay or hold back a prize in case of rule violations or false data.
6. D, Premium and the shop
6.1. D is the Platform's internal virtual unit. D is not money, electronic money, a security or other property; it cannot be withdrawn into real money or exchanged for it.
6.2. D is credited as bonuses (for example, for the first approved verification and the first approved profile photo), as tournament prizes and in other cases provided by the Platform. D can be spent on tournament entry fees ("DEAFESG account"), the Premium subscription and shop items.
6.3. The price and duration of Premium are shown on the Premium page. The subscription is bought with D, starts immediately and is extended by buying it again; a promo code extends the subscription by the number of days stated in it. Because the service is provided immediately after purchase, the D spent are not refunded, except where the service was not provided through the Website's fault.
6.4. Shop items are digital, tied to the account and not transferable to other Users. The Administration may change the set of items, their price and the conditions for getting them (for example, a required rank).
6.5. The Administration may correct erroneous credits and debits of D. The Administration may cancel D and items obtained dishonestly.
7. Messages and Users' materials
7.1. The Platform provides messages: private conversations, team chats, the tournament captains' chat and the official DEAFESG channel. The User is solely responsible for the content of the messages and photos they send.
7.2. A person you do not know can be sent a request — one message; the conversation begins when the recipient accepts the request. A User may add a person to the blacklist and report a message.
7.3. The Administration does not read private conversations, except in cases of a report (managers see the reported message and a few before it), legal requirements and the need to keep the Platform safe. The tournament chat may be viewed by managers of the Administration; it is where the captains of the teams that applied to the tournament talk. After the tournament finishes, the tournament chat messages are deleted.
7.4. Messages deleted by their author are not restored. A copy of a reported message (together with a few before it) is kept in the report record.
7.5. By uploading photos and other materials, the User guarantees that they hold the rights to them and the consent of the people shown. The Platform accepts JPEG, PNG and WebP photos, shrinks them and removes hidden data (including the place where they were taken).
7.6. The User gives the Administration a non-exclusive right to use the materials they post within the work of the Platform (storage, display, moderation) for as long as they are posted. Nickname, avatar, rating, team rosters and tournament results are shown publicly.
7.7. The Administration may delete material that violates the Offer or the law.
8. Personal data
Personal data is processed in accordance with the Privacy Policy published on the Website at https://v2.deafesg.com/legal/privacy. By accepting the Offer, the User confirms that they have read the Policy.
9. Intellectual property
9.1. The Website, its design, source code, logos and the DEAFESG names belong to the Administration or are used on a lawful basis. Copying and automated collection of data from the Website without the Administration's consent (except as provided by the public API) is forbidden.
9.2. The names of games and services (Fortnite, Counter-Strike, Steam, FACEIT and others) belong to their owners. The Platform is not affiliated with game publishers and does not act on their behalf unless stated otherwise.
10. Availability of the Platform and liability
10.1. The Platform is provided "as is". The Administration strives for uninterrupted operation but does not guarantee the absence of errors and interruptions or continuous availability of the Website, including because of maintenance and updates.
10.2. The Administration is not responsible for: the actions of other Users; the work of games and third-party services (Steam, FACEIT, Epic Games, Riot Games, Discord, Telegram, Google Drive and others); the consequences of losing access to an account through the User's fault; interruptions of the User's internet connection and equipment.
10.3. To the extent permitted by law, the Administration's liability is limited to actual damage and does not exceed the entry fee paid by the User for the tournament concerned. The Administration is not liable for lost profit.
10.4. The User compensates damage caused to the Administration or to other Users by a violation of the Offer.
10.5. The parties are released from liability for failure to perform obligations caused by force majeure.
11. Changes and termination
11.1. The Administration may change the Offer unilaterally. The new version takes effect when it is published on this page; the date of the last update is given at the end. Continuing to use the Website after changes are published means agreement with the new version.
11.2. The User may stop using the Website and delete the account at any time. The Administration may restrict access or block an account in case of a violation of the Offer.
12. Final provisions
12.1. The relations of the parties are governed by the law of the Russian Federation. The parties seek to settle disputes by negotiation: a claim can be sent to support@deafesg.com, with a response period of 30 calendar days. If the dispute is not settled, it is heard in court in the manner established by law.
12.2. If any term of the Offer is found invalid, the remaining terms stay in force.
12.3. The Offer is published in Russian and English. If the texts differ, the Russian version prevails.
